Introduction to Ordinance No. 5115

The Chandler City Council voted to introduce Ordinance No. 5115, which approves the Right of Way Temporary Use Management Program. If adopted on Jan. 9, 2025, and taking effect 30 days later, this ordinance aims to bring more efficiency to the use of temporary traffic restrictions. Approximately 1,900 temporary traffic control permits are issued annually for various construction activities in the city.During a May 2024 City Council work session, traffic restrictions became the focal point. The council discussed project coordination, driver safety, and the frequency and duration of road restrictions. Based on this discussion, Transportation Engineering Division staff developed two programs to enhance road construction coordination.The first program is a right of way temporary use fee program. This not only incentivizes contractors to complete their work timely but also holds them accountable if they fail to do so. The second program is the right of way temporary use management policies and procedures, which will enhance the planning, application, and oversight of traffic control in temporary work areas. The goal is to maintain work zone safety while minimizing disruptions to the public.

Details of the Ordinance

This ordinance gives Chandler the authority to collect fees. It includes a non-refundable permit fee to cover the cost of plan review and inspection. Additionally, a deposit based on the size of the project is required for all work involving lane restrictions or closures. The deposit is fully refundable if the work is completed as per the specifications and timeframe authorized by the temporary traffic control permit and if the city infrastructure remains undamaged during construction.Certain actions can lead to a civil violation of the ordinance. These include using the right of way without a city-approved traffic control permit, not adhering to the limits, times, and locations specified in the permit, and restricting traffic at a signalized intersection without active work or a sworn police officer present.Contractors working on city-owned projects or contracts must comply with this policy and obtain a temporary traffic control permit.
