Controversy Halts Campaign Reporting Reform in New Mexico

A legislative effort to refine New Mexico's campaign finance transparency rules faced an unexpected setback last week. The proposal, which sought to tighten regulations on political spending and donor disclosure, encountered fierce resistance from nonprofit advocacy groups who feared it would inadvertently restrict their activities.

The opposition centered on a specific clause within the bill that aimed to redefine what constitutes a "political expenditure." Critics argued that removing the phrase "for a political purpose" could broaden the scope of activities considered political, potentially subjecting nonpartisan educational efforts by 501(c)(3) organizations to stringent reporting requirements. According to Lan Sena, policy director for the Center for Civic Policy, this change might classify routine public awareness campaigns as political actions, thus compelling these groups to reveal their financial backers. Several prominent organizations, including ACLU, Café ACCION, and NM Native Vote, aligned themselves against the measure, voicing concerns about its implications for their operations.

Despite Senate Majority Leader Peter Wirth's assertion that the bill merely formalized existing regulatory practices, the pushback proved insurmountable. During the hearing, Lindsay Bachman from the Secretary of State’s office clarified that current regulations already limit reporting obligations to certain periods before elections. However, this explanation did not assuage the apprehensions of the opposing groups. As the session drew to a close, time constraints further complicated the matter, leading Wirth to abandon the initiative for now. While acknowledging the value of the dissenting organizations, he expressed his intention to reintroduce similar legislation in subsequent sessions.

Even though the recent attempt to enhance campaign finance laws faltered, it underscores the importance of thorough consultation with all stakeholders.
